Overseeing Injured or Disabled Employees: Response, Requirements & Resources for Employers
August 22, 2023 | 10:00a.m. – 11:00a.m. PST | 30 Days of On-Demand Access to Follow
Whether it’s the result of an on-the-job injury or due to a separate medical condition, injured or disabled employees present legal challenges for employers to navigate. Numerous laws may be in play, including workers’ compensation reinstatement and reemployment, disability accommodation, protected leave covered by the FMLA or OFLA, and general anti-discrimination and anti-retaliation laws that present legal risk upon separation of employment. Join Barran Liebman attorney Bruce Garrett as he explores the legal and practical implications employers need to consider when they have injured or disabled employees.
Key learning objectives will include the following:
- Gaining a better understanding of your legal obligations as an employer as well as best practices for engaging with injured or disabled employees;
- Maintaining compliance with employer obligations and affirmative duties regarding employees who return from workers’ compensation leave;
- Establishing effective protocols for engaging in the interactive process and accommodating disabled employees; and
- Leveraging decision-making strategies when faced with challenges around injured or disabled employees, including termination of employment.
