Developing Your 2026 Pre-Employment Due Diligence Strategy

As we move into the new year, pre-employment screening faces significant shifts toward fairer, more inclusive hiring alongside increased compliance complexity. Now is the time to audit your screening processes to ensure they meet evolving legal requirements while protecting your organization!
 
Here are some key things to keep in mind when planning for 2026:
 

Foundation: FCRA Compliance

Under the Fair Credit Reporting Act, employers must obtain clear written consent from applicants before running background checks and provide proper disclosure about the nature of the background report.
 
This disclosure must stand alone—never buried within application packets. When adverse findings surface, employers must provide pre-adverse action notification, including a copy of the report and a summary of consumer rights under the FCRA.
 

Navigating State-Level Variations

More than 35 states and 150+ local jurisdictions have adopted Fair Chance practices prohibiting employers from asking about convictions on job applications.
 
Additionally, Clean Slate laws require employers to avoid evaluating sealed or expunged records. These requirements vary significantly by jurisdiction, making multi-state compliance increasingly complex.
